CONDITIONS OF USE FOR THE PROVISION OF THE SERVICE

2. Object of the service
2.1. Object of the service
This document establishes the conditions of use that will regulate the service provided by GRADIANT to the users of the website which offers the service of digital content fraud detection, which is available at the URL https://www.veraquo.gradiant.org.
These Terms of Use regulate the online access permission for users to the content validation services, providing a procedure and a secure channel for its use through electronic means.
GRADIANT may also make changes to these Terms of Use, of which users will be informed in advance so that they can accept or reject them if they are substantial. In any case, the user will be deemed to have expressly accepted these modifications or updates if he/she returns to use the services offered by GRADIANT on the Website once the new Terms of Use have been adapted.
GRADIANT also reserves the right to modify, update or discontinue features, functionalities or pricing of the service at any time.
If accepted by the user, the new conditions of use will fully replace the conditions in force up to that time, and will take effect for new subscriptions used by the user from the date of acceptance of the new conditions.
The ticking of the corresponding box in the process of use, as well as the fact of following telematically all the steps established for the same, implies the express acceptance of the present Conditions of Use by the user, having the same validity as their acceptance in person. In this way, the user recognises that he/she is a person with sufficient capacity to acquire the obligations derived from his/her actions through the Website, that he/she has previously read and understands its content.
If the new conditions of use are not accepted, it will not be possible to continue using the service.
3. Definition of content validation services
The users will be able to gain access, after accepting the terms and conditions exposed in this section of the website, to the following content validation services:
Veraquo assesses the trustworthiness of digital content (including documents, images, audio and video) to prevent fraud. The technology allows companies to offer an extra level of security and prevent fraud by analysing content created by AI.
4. Procedure for the use of the Services
The procedure for using the Services is carried out entirely electronically through the Website. The Services may be requested twenty-four (24) hours a day, every day of the week. The right to interrupt the Services for system maintenance or any other reason is reserved to GRADIANT.
The applicant must provide the identification details required for the correct identification of the user by GRADIANT and, where applicable, accredit the representation and interest claimed for the query, in addition to the data necessary for the query and other data required by law.
Users may identify themselves in any of the following ways:
Filling in the data required on the form provided for this purpose (Book a Meeting), or using the e-mail address included in the website.
4.1 Users who may have access to the Services
They may be users and, therefore, request the Services, natural and legal persons duly identified. However, the application for the Services must always be made by a natural person, of legal age and with full capacity to contract on their own behalf or on behalf of the legal person in whose name the application is made, representation that must be accredited in accordance with current legislation, the applicant being responsible for the veracity of the data provided for this purpose in the form for the start of the procedure.
5. Conditions of use of the validations carried out
The content of the information provided by means of the Validation Services is for the private and exclusive use of the user who requests it, solely for the purposes for which it is intended, and may not be used for commercial purposes. Under no circumstances may the user modify, adapt, communicate, make available, divulge or market said information, in whole or in part, either for a fee or free of charge, for any purpose other than that described. Specifically, in compliance with current legislation, the user undertakes not to incorporate said information into databases or files that may be susceptible to individualized consultation by natural or legal persons other than the user (including, where applicable, their employees).
The user of the Validation Services, by the mere fact of requesting the information, accepts and undertakes to use the validations obtained in accordance with the rules and limitations established by personal data protection legislation, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data; as well as the applicable national regulations in force at any given time in this area.
6. User services
GRADIANT, as the party responsible for the Website and in charge of the management of the Services offered through the same, provides users with a user support service, available from Monday to Friday, from 9:00 to 17:00 CET, where due attention shall be given to all queries and suggestions raised in relation to the subscription of any of the Services.

7. Responsibilities
The contents subject to validation shall be understood in any case, and for all purposes, provided by the User, who shall be solely legally responsible for their content, accuracy or veracity. Veraquo merely guarantees a procedure and a secure channel for the validation of the same, but is in no way responsible for their content. The user fully exonerates GRADIANT from any liability that may arise from the content of the information provided or the consequences for the user of the existence of deficiencies in the same.
The results provided by Veraquo are based on artificial intelligence models and may be probabilistic in nature. Therefore, they should not be considered as definitive proof and must be interpreted within their appropriate context.
8. Access to Veraquo
Veraquo may offer both free and paid subscription plans, with different usage limits and features. Users may upgrade their plan at any time to access additional features or increased usage limits.
These Conditions apply to all users of the Veraquo platform, regardless of the selected plan.
9. Subscriptions and Plans
Free plans may include usage or feature limitations, which may be updated from time to time.
Veraquo may offer both free and paid subscription plans. Paid plans may be subject to periodic billing. Users may cancel their subscription at any time, with effect at the end of the current billing period.
10. Severability Clause
In the event that any provision or term of these Terms of Use is declared invalid by a court judgment or final arbitration award, the remaining provisions shall not be affected. In such an event, the clause or clauses affected shall be replaced by one or more other clauses that preserve the effects pursued by the Terms of Use of the Website.
